The User must read this document carefully.
The Terms and Conditions ("Terms") govern your relationship with Curricular.dev website (the "Service", "Curricular"), operated by Curricular Inc ("us", "we", "our").
By using curricular.dev, you confirm your acceptance of and agree to be bound by these terms and conditions.
This Agreement takes effect on the date on which you first use the iCodeThis.com application.
To access most features of the Curricular Service, users must register for an account.
When you register for an account, you may be required to provide us with some information such as your name, email address, payment information, location, or other contact information. We strictly prohibit you from providing any sensitive personal data to us. You agree that the information you provide to us is accurate, complete, and not misleading, and that you will keep it accurate and up to date at all times.
Users are responsible for keeping their login credentials confidential and safe, and for choosing passwords that meet the highest standards of strength.
As a user, you agree to be fully responsible for all activities that occur under your account, and furthermore agree that all activities will be in accordance with this agreement.
Account Suspension or DeletionCurricular reserves the right, at its sole discretion, to suspend or delete at any time and without notice, User accounts which it deems inappropriate, offensive or in violation of these Terms.
The suspension or deletion of User accounts shall not entitle Users to any claims for compensation, damages or reimbursement.
The suspension or deletion of accounts due to causes attributable to the User does not exempt the User from paying any applicable fees or prices.
Some features of the Service require purchase of a subscription. The details of the premium features requiring subscription are available on the pro page.
Curricular reserves the right, at its sole discretion, to remove features from its subscription service. Curricular will seek to notify users of such changes prior to removal of features. But Curricular makes no representation or guarantee of providing such notice, and User accepts that they may not receive notice of removal of a feature of the subscription service.
We allow refunds within 7 days of purchase of your first month of using Curricular Pro. Cancel your subscription and contact us at support@curricular.dev.
If you request a refund, Curricular will review your account activity to determine eligibility for a refund. Depending on your level of use, Curricular may determine you are ineligible for a refund. An example scenario that would disqualify you for a refund would include downloading materials for all Pro projects prior to requesting a refund. Curricular retains the sole right and discretion to decide whether an account is eligible to receive a refund, and issuing a refund to one customer does not obligate Curricular to refund future customers.
Unless where otherwise specified or clearly recognizable, all content available on Curricular is owned or provided by Curricular or its licensors.
Curricular undertakes its utmost effort to ensure that the content provided on Curricular infringes no applicable legal provisions or third-party rights.
Users are kindly asked to preferably report related complaints using the contact details provided in this document.
All Rights ReservedCurricular Inc holds and reserves all intellectual property rights for all content available on Curricular.
Users may not therefore use such content in any way that is not necessary or implicit in the proper use of the Service.
Where explicitly stated on Curricular, the User may download, copy and/or share some content available through Curricular for its sole personal and non-commercial use and provided that the copyright attributions and all the other attributions requested by the Owner are correctly implemented.
Users may not copy, download, share (beyond the limits set forth below), modify, translate, transform, publish, transmit, sell, sublicense, edit, transfer/assign to third parties or create derivative works from the content available on Curricular, nor allow any third party to do so through the User or their device, even without the User's knowledge.
In some cases, Curricular may grant permission for commercial use. This permission is only ever explicitly granted through direct written communication separate from this Agreement.
Any applicable statutory limitation or exception to copyright shall stay unaffected.
It is not warranted that the Service will meet your requirements or that its operation will be uninterrupted or error free. All express and implied warranties or conditions not stated in this Agreement (including without limitation, loss of profits, loss or corruption of data, business interruption or loss of contracts), so far as such exclusion or disclaimer is permitted under the applicable law are excluded and expressly disclaimed. This Agreement does not affect your statutory rights.
Curricular does not give any warranty, guarantee or other term as to the quality, fitness for purpose or otherwise of the software. Curricular shall not be liable to you by reason of any representation (unless fraudulent), or any implied warranty, condition or other term, or any duty at common law, for any loss of profit or any indirect, special or consequential loss, damage, costs, expenses or other claims (whether caused by Curricular's negligence or the negligence of its servants or agents or otherwise) which arise out of or in connection with the provision of any goods or services by Curricular.
The Service shall not be liable or deemed to be in breach of contract by reason of any delay in performing, or failure to perform, any of its obligations if the delay or failure was due to any cause beyond its reasonable control.
Notwithstanding contrary clauses in this Agreement, in the event that Curricular are deemed liable to you for breach of this Agreement, you agree that Curricular's liability is limited to the amount actually paid by you for your services or software, which amount calculated in reliance upon this clause. You hereby release Curricular from any and all obligations, liabilities and claims in excess of this limitation.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, Curricular will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at Curricular's sole discretion.
By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are advised to stop using the Service.
These Terms shall be governed and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.
